By accessing or using FixLA ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

FixLA is a community platform that allows users to report and verify civic issues in Los Angeles County, including but not limited to homeless encampments, graffiti, trash, and potholes. The Service is provided "as is" and "as available."

3. User Responsibilities

By using the Service, you agree to:

• Provide accurate and truthful information in your reports
• Only upload photos that you have the right to share
• Not submit false, misleading, or malicious reports
• Not use the Service for any illegal purpose
• Not harass, abuse, or harm other users
• Respect the privacy of individuals who may appear in photos

4. User Content

You retain ownership of content you submit. By submitting content, you grant FixLA a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Service. You represent that you have all necessary rights to submit the content.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXLA AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any content or conduct of any third party on the Service
• Any actions taken by government agencies or other parties based on reports submitted through the Service

7. Indemnification

You agree to indemnify and hold harmless FixLA, its operators, affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

8. No Government Affiliation

FixLA is not affiliated with, endorsed by, or connected to any government agency, including the City of Los Angeles or Los Angeles County. Reports submitted through this Service are not official government reports and may not result in any government action.

9. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for any reason, including violation of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
